Conditions of Sale
a) The offer and sale of footwear bearing the FLY FLOT brand on the website www.flyflot.it are governed by the following General Conditions of Sale.
b) Products bearing the FLY FLOT brand, purchased on the website www.flyflot.it are produced and sold by Fly Flot Srl, registered in the Brescia Company Register, no. 541664, VAT number 03526490986, with headquarters in Calvisano (BS), Via Isorella, 47.
c) Purchase transactions are regulated, among other things, by the provisions of the d.lgs. n. 206 of 06.09.2005 (Consumer Code) pursuant to which:
I) "online sales contract" means the distance contract, i.e. the legal transaction having as its object movable goods and/or services stipulated between a professional, in this case Fly Flot Srl, via the online service www.flyflot.it, and a consumer, within the framework of a distance selling system organised by the professional who, for that contract, uses exclusively the distance communication technology called the Internet;
II) "consumer" means a natural person of legal age who acts for purposes other than any business or professional activity he or she may carry out.
ART. 1 ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
a) All contracts will be concluded directly by accessing the website corresponding to the address www.flyflot.it, where the customer can conclude the contract for the purchase of the desired good and/or product by carefully following the instructions and procedures provided.
b) These general conditions of sale are an integral and essential part of the sales contract. Therefore, they must be reviewed online by the customer before completing the purchase process. Submitting the order confirmation therefore implies full knowledge of the terms and conditions and their full acceptance.
c) The general conditions of sale may be updated or modified at any time by Fly Flot Srl, which will provide notice of this on its website.
d) By electronically confirming their purchase order, the customer unconditionally accepts and undertakes to observe, in their dealings with Fly Flot Srl, the general conditions of sale, including the payment terms illustrated below, declaring that they have read and accepted all the information provided.
ART. 2 SALES PRICES AND PURCHASE METHODS
a) All sales prices of the products displayed and indicated on the website www.flyflot.it for which they constitute an offer to the public pursuant to art. 1336 c.c. , are inclusive of VAT and any other taxes relating to the sale.
b) The total cost of shipping and handling will be clearly indicated and displayed before the order is finalized.
c) The purchase contract is finalized by correctly completing the form and expressing consent to the purchase via the online form, subject to successful payment. d) The customer can pay for the ordered goods using the payment methods indicated online at the time of purchase.
ART. 3 GIFT VOUCHERS
When purchasing a gift voucher, the buyer is required to pay the selected amount by credit card. Once Fly Flot receives the credit, it will send the recipient an email containing all the information needed to use the voucher.
Please note that the beneficiary of the voucher will be able to purchase any type of product published in the online shop www.flyflot.it Without limitations. Please also note that the gift card code can be used within the same order.
If the gift card is partially used by the recipient, the remaining amount will be credited back to the buyer's credit card after the order is placed.
ART. 4 DELIVERY METHODS
a) Shipping costs Shipping costs are calculated based on the order amount and the destination country.

b) Fly Flot Srl will hand over the selected and ordered products to its trusted courier, thereby completing the delivery, so that they can be transported to the customer at the address indicated by the customer.
c) Fly Flot Srl will do its best to process orders sent within 7 working days and in any case the purchased goods will be delivered within the terms set out in art. 54 of the d.lgs. 205/06, within 30 days from the day after the consumer placed the order with the professional. Fly Flot Srl cannot be held liable for delayed or failed delivery due to force majeure or unforeseeable circumstances.
d) The customer is required to verify, upon receipt, that the product delivered to them conforms to the order placed. By completing the personal information form in the registration process required to initiate the execution of this contract and any related communications, the consumer and/or customer authorizes Fly Flot Srl to communicate non-sensitive personal information (address, telephone number) to the trusted couriers and/or shipping agents used to deliver the purchased goods in order to allow for the necessary delivery procedures.
ART. 5 RESPONSIBILITY
a) Fly Flot Srl assumes no responsibility for disruptions attributable to force majeure, such as, for example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, execution within the timeframes agreed upon in the contract.
b) Fly Flot Srl will not be liable to any party or third parties for damages, losses, and costs incurred as a result of failure to perform the contract for the reasons mentioned above. The customer is only entitled to a refund of the price paid.
c) Likewise, Fly Flot Srl is not responsible for any fraudulent or illicit use by third parties of credit cards, checks, or other means of payment when paying for purchased products. At no point during the purchase process is Fly Flot Srl able to access the customer's credit card number, which, through a secure connection, is transmitted directly to the banking service provider.
d) If you have a credit card, you can choose to save your card details: this way you won't have to enter them for future payments.
The data you provide will be collected by Fly Flot Srl and processed in accordance with the law.
Remember that you will be solely responsible for the data you enter, so only use credit cards that you have legitimate access to.
e) If you have an active credit card on your PayPal account, the system allows you to save a recognition code so you don't have to re-enter your credentials for future payments.
The data you provide will be collected by Fly Flot Srl in encrypted form and transmitted to PayPal.
PayPal will store and process the above data independently, according to the highest security standards and solely to process your purchases on our site. www.flyflot.it.
ART. 6 CUSTOMER OBLIGATIONS
a) the customer undertakes and undertakes, once the "online" purchase procedure has been completed, to print and keep these general conditions, which, moreover, he will have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product being purchased, and this in order to fully satisfy the condition set out in articles 52 and 53 of the d.lgs. 205/06;
b) minors are strictly prohibited from placing an order online.
c) The customer is strictly prohibited from entering false, invented, or fictitious information in the registration process required to initiate the execution of this contract and any related communications. Personal details, address, telephone number, and email address must be their own personal data and not those of third parties or fictitious.
d) The customer indemnifies Fly Flot Srl from any liability arising from the issuance of incorrect tax documents due to errors in the data provided by the customer, being the customer himself solely responsible for their correct entry.
ART. 7 RIGHT OF WITHDRAWAL AND COMPLAINTS
a) Pursuant to art. 64 of the d.lgs. 205/06 the consumer can exercise the right of withdrawal and return the product received, in compliance with the terms and conditions set out below.
b) Any consumer who, for any reason, is not satisfied with their purchase has the right to withdraw from the contract within 14 working days of the order being delivered by contacting customer service on 030/9689214 (from 9:00 to 12:00).
c) Please note that items must be returned intact and in the same condition in which they were received, complete with the barcode tags and any other seals that are part of the product.
d) In the event that all the conditions and obligations of the consumer set out in the previous points have been respected, Fly Flot Srl will refund the sale price of the purchased item by direct crediting to the card used for payment or to the PayPal account, within 14 calendar days starting from the date of acceptance of the return by our logistics.
ART. 8 PAYMENT METHODS
a) By filling in the appropriate space on the website of the payment banking system, the consumer and/or customer authorizes Fly Flot Srl to use their credit card and debit their current account in favor of Fly Flot Srl for the total amount shown as the cost of the purchase made "online".
b) If you have a credit card, you can choose to save your card details: this way you won't have to enter them for future payments.
c) Should the consumer exercise the right of withdrawal, as provided for in these contractual conditions, the amount to be refunded will be credited directly to the credit card or PayPal account or by re-crediting the current account if paid by bank transfer. A specific request must be sent to customer service by calling 030/9689214 (from 9:00 to 12:00).
d) For payments made by cash on delivery, the amount is considered settled upon delivery of the order. Payment must be made in cash upon delivery (checks are not accepted).
ART. 9 EXPRESS TERMINATION CLAUSE
a) Fly Flot Srl reserves the right to terminate the contract by simply notifying the consumer and/or customer with adequate and justified reasons; in this case, the customer will only be entitled to a refund of any sums already paid.
b) The obligations assumed by the customer pursuant to art. 7 of these conditions (customer obligations), as well as the guarantee of successful payment that the customer makes using the methods referred to in art. 2, are of an essential nature, so that by express agreement, the failure by the customer to fulfill even one of these obligations will result in the termination of the contract by operation of law pursuant to art. 1456. c.c. , without the need for a judicial ruling, without prejudice to the right of Fly Flot Srl to take legal action for compensation.
ART. 10 JURISDICTION AND COMPETENT COURT
a) Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated "online" via the website www.flyflot.it is subject to Italian jurisdiction; these general conditions refer, for anything not expressly provided for therein, to the provisions of the Civil Code, as well as to the d.lgs. 205/06.
b) Any dispute between the parties regarding this contract will be subject to the jurisdiction of the court in the district in which the consumer is domiciled; for all other disputes, the Court of Brescia will have exclusive jurisdiction.
